If I were to cancel, I would send an email to all email addresses listed above, send faxes to Playa Grande and ResortCom, and send the same cancellation letter certified mail return-receipt to Playa Grande and ResortCom. Follow up with a phone call. If they refuse to cancel, start a formal complaint with PROFECO. If you are within the 5 day allowed by Mexican law, there's no way you can lose.

  1. Hi, this is very useful information. I've been trying to cancel my timeshare membership with Grand Solmar which I signed up on May 31st. I sent cancellation email to memberservices@resortcom.com and Fax to ResortComm on June 7th. I didn't sent a certified mail though. I got a phone call from them the next day saying that I failed to follow the cancellation procedure in the contract withing 5 days period. According to your blog that the day I canceled is the 5th business day which my cancellation should be valid by law. The only thing I didn't do is that I did not send the cancellation letter via mail. Do you think I can get cancellation? thank you.

  2. Hi. Sorry for the late response, but yes I think you can get out of it. Get in touch with PROFECO. If they did anything shady, like tell you that you can't cancel, then they have violated consumer protection law and you'll win.

  3. I'm going through the same problem right now, but I don't think I can go through Profeco. I bought the time share last month, and just realized half of the things they told me were lies and of course no one is returning my calls and they keep on forwarding me to different numbers who are no help. Even though I purchased the time share last month do you think I can still file a complaint with PROFECO? Or should i just file a complaint with my credit card and try to cancel it? Any advice would be great! Thanks!

  4. You should go through PROFECO. I don't think the credit card companies will help much, but you can try to dispute the charges. If any of the lies were written on paper, then you have a stronger case with PROFECO. For instance, if they wrote on your payment slip that the deposit was non-refundable, that's a good case.

  5. Hi, I purchased with Grand Solmar on Jan 9th, went back on the 13th and 14th trying to rescind and they refused to cancel my contract. Then they agreed to cancel the remainder of what is owed, but they wanted me to sign a letter saying that I agreed to cancel, but I would not be refunded my "administrative fee" of $1190 or my down payment. I refused to sign, but kept a copy of the dated letter showing I was there with intent to cancel. I also emailed and faxed my letter of rescission to resortcom within my 5 days. It was Saturday in MX so I was unable to get to the post office to send a certified letter as well. I also sent an email to PROFECO within the 5 day period just to let them know what my intentions were and that I had been trying to cancel but keep getting denied in person. Do you think I have a chance of getting my refund?

    1. Definitely. Make sure that you do send that certified letter and notify PROFECO. The fact that they tried to prevent you from getting a full refund when you cancelled is a good case for being misled. Be persistent, and good luck!

    I foolishly bought a timeshare about a year ago at Villas del Arco, in Cabo also, came home and was injured three months after the sale, I called and tried to cancelled since they had $3,000 and I hadn't even used the membership only to find out I couldn't. Now its been over a year, I'm still recovering, still they won't let me out and I don't want to damage my credit. I will start writting a formal cancellation letter and fax, and mail to where you stated, file complaints with PREFACO and US Attorney's office if I have to. They have to let us out, we've spent over $5000 and never used this..

  8. Mass production, my husband and I find ourselves in the same predicament. We purchased our timeshare Monday April 13th 2015 and have emailed, faxed, called, and certified mailed our cancellation letter to the listed contacts in your post and have notified Profeco of our actions and intent. We are being told that "working days" in Mexico are everyday because of the fact that the resort is up and running everyday and that we exceed the "5 working days" as it applies in Mexico and not the U.S. Monday -Friday working days. We are also told that Profeco is nothing more than a business bureau and that we would need to hire a Mexico lawyer if we wanted to follow through with our attempts in getting our money back and canceling our contract without penalties. Please share any advice thoughts or feedback that you might have for us. Thank you

    1. They're lying to you to get you to back down. Working days are weekdays only and excludes holidays. Profeco will represent you on your behalf, so you will not need to hire a lawyer. You have done everything right so far. I hope they ruled in your favor.

  9. Thank you for this site! It saved me $40k and years of headache if I had proceeded with a timeshare at grand Solmar. I discovered this site on the 4th day after signing my contract and knew something just didn't feel right. I immediately sent an email to the contacts above and requested a full refund referencing Mexican consumer law. I copied profeco on the email which scared the crap out of them and outlined all the ways they tried to scam me. Luckily, I was still on site and grand Solmar and went to the sales office first thing that morning. They tried to give me a verbal only that they would give me a refund but I gave them a hard copy of my letter to dissolve the agreement and demanded they issue the refund on the spot with a copy of the transaction. Within 3 days I had my money back and an apology from Dulce! See his new contact information below.

  10. I'm going through this right now with grand solmar. We purchased the timeshare February 19 2017 and were not notified of this cancellation policy or procedures. We were told to wait 4-6 weeks till account was activated. We began to contact them after 6 weeks since this has not yet been activated. As soon as it was activated after countless calls, it turned out that what we were promised by manuel and ace was a lie. We then imedatly attempted in canceling. We only got the run around for several months. Today October 25 2017, we received any email from alejandra that they are keeping 40% of the total purchase price and legal fees but she still states that we can proceed with cancellation with no more "financial obligations". We are trying to get our full refund. This has been a nightmare and without a single use of the timeshare. We've been lied to from the start and now feel robbed. How can I pursue my full refund? Please help with any information. Thank you.

    1. I suggest that you still reach out to PROFECO to see if there is anything that can be done. If any of the forms that you signed say that there is no refund or that you waive your rights, that's illegal and may help your case.

  11. Does anyone have email and mailing addresses for Grand Solomar. I talked to them today and gave them a copy of my request to rescind that detailed my rights to a full refund. She took all my paperwork and said they would cancel my contract. I asked her to sign that she received it. To cut to the chase she kept the contract and wouldn't sign a letter of receipt said they they would give me a full refund. I won't have time to visit PROFECO in person. There was no email or clear address to send a letter to in the paperwork. I looked everywhere.
    BTW, I video taped the conversation with her so I hope that will help.
